Terms of Use
By subscribing to Pick the Score, and provided you (the "User") are 18 years of age or older, you will be deemed to have manifested your consent to enter into the following agreement with Pick the Score and to accept its terms and conditions, which have been accepted by Pick the Score. Please read the agreement carefully, and consult legal counsel in your jurisdiction if you have any doubts about your rights and obligations; be sure to keep a copy for your records.

Purpose Of Agreement
The purpose of this Agreement is to regulate the legal relationship between Pick the Score and the User once the User has received the Pick the Score  software from www.pickthescore.com. Pick the Score  hereby grants the User a personal, non-exclusive, non-transferable sub-license to use its website.

Declarations by User
The User declares and warrants that: 
All User's details contained in the Registration Form submitted to Pick the Score  are true and correct.
  • User will use the software application to to access sports news, blogs and stats and games of skill content on the Internet for his own private personal use only and not for any business use, or use by others.
  • Commercial use of Pick the Score  is strictly prohibited.
  • To the best of his knowledge, User is not contravening any laws of his home jurisdiction to access this online content on the Internet.
  • User fully understands the methods, rules, and procedures of subscribing to Pick the Score website.
  • User is fully aware that by paying the weekly subscription to Pick the score on the internet that this payment is non-refundable.
  •  The Player accepts all outcomes of any game of skill results as received in the client application from Pick the Score server. The Player fully accepts and agrees that software points generator will determine the outcome of the games of skill that the weekly subscription allows the user to play.
  • The source of the funds used by User for subscribing to Pick the Score for sports news, blogs and stats and games of skill on the  Pick the Score website is not illegal.

Declarations by Pick the Score  
Pick the Score  declares and warrants that:

  • Pick the Score 's operation of a subscription site for sports news, blogs and statistics and games of skill.
  • Use of the site for its game of skill on the Internet ensures all users equal chance to predict the outcome of a tournament or event it is promoting.  
  • Using the latest private/public key encryption, Pick the Score  has made every reasonable effort to ensure that all passwords and user names employed by User are thoroughly secure against third party access while transferred on the Internet.

Rules and Instructions
The use of the Pick the Score website by the User shall be made exclusively in accordance with, and governed by, Pick the Score 's rules and instructions as detailed on Pick the Score 's Internet web site from time to time, including, without limitation, in respect of the game prediction methods, playing rules, payment procedures, and payoffs of winnings.  

Telecommunication Service Provider
Pick the Score  shall not, in any way, be responsible for any acts or omissions made by User's Internet Service Provider ("ISP") with whom User has contracted to gain access to Pick the Score , and Pick the Score  shall not be a party to any dispute between user and ISP, nor shall any such dispute have any effect on the obligations of User under this Agreement. Trademarks
User undertakes to respect all applicable copyrights and/or trademarks related to Pick the Score  operation and its website, and to exercise all necessary prudence in the use of the encryption key and other security measures.

User Abuse
In the event that Pick the Score  believes a User is abusing or attempting to abuse a bonus or other promotion, or is likely to benefit through abuse or lack of good faith from a game policy adopted by Pick the Score  then Pick the Score  may, in its absolute discretion, deny, withhold or withdraw from a User any bonus or other promotion, or rescind any policy in respect of that User, either temporarily or permanently.

Termination
User may terminate this Agreement by notifying Pick the Score  in writing at any time. Terminationation will deemed to be made at the end of the period of the next weekly subscription that has been paid and no refund for the final weekly subscription will be made to the User. Pick the Score at no time owes money other than what is owed to a User as a legitimate prize winner of a Pick the Score weekly game of skill. Through an e-wallet account the user controls their own money online and chooses at their own discretion to subscribe from week to week to sports news, blogs and statistics and games on the Pick the Score account paid from their e-wallet account.  Pick the Score  reserves the right to terminate User's membership, at any time and for any reason, at its sole discretion, and in particular in case of any activity that may harm Pick the Score  and/or its members including, but not limited to, fraud, abuse of bonuses and other promotions, frivolous and unsubstantiated claims, and misuse of Pick the Score’s software and website. Upon termination by User or Pick the Score  as above, Pick the Score  if has not already done so, shall debit or refund User any prize funds (if any), which may be legitimately owed to the User. In any case, refund shall not exceed what may be legally owing to the User in regard to any cash prizes owing. Termination by User or Pick the Score  as above shall be without prejudice to recovery by either party of any amount legally due by the other party in virtue of this Agreement.

Applicable Law / Jurisdiction
This Agreement, the interpretation and execution thereof, and the relationship between the parties, shall be governed by, and construed in accordance with, the laws of New Zealand. Any claim or dispute arising either directly or indirectly out of this Agreement, shall be brought before the competent court of the country of New Zealand which court shall have exclusive jurisdiction. Notwithstanding the foregoing, Pick the Score  shall have the right to institute any legal proceedings against the User before the competent court in the User's home jurisdiction or elsewhere. Amendments
Pick the Score  reserves the right to amend these Terms and Conditions from time to time as it sees fit. Users are advised to review these Terms and Conditions no less than once per month on the Pick the Score  website in order to ascertain what amendments, if any, have been made.

THIS AGREEMENT IS DEEMED ACCEPTED AND SIGNED BY PICK THE SCORE   ON THE DATE ON WHICH THE USER REGISTERS ON THE PICK THE SCORE WEBSITE.
